The Barnett Govt, acting in self-interest, is trying to evict troublemakers from its HomesWest properties.  To achieve this, Colin and Troy are changing all the rules in the Residential Tenancies Act - Owners come last.

As part of this eviction process they need to be sure there will be a  home for the evicted reprobates - your rental property may be on top of the list. Be ready for this. 

The new Act will make it nearly impossible to refuse a ratbag possession of your property.    49 Fines for Property Owners - 3 for Tenants. New fines of $5,000 up to $20,000 for owners,  tenants usually get off Scot Free - This is a serious assault on property ownership. 

Criminals get smaller fines, and, often, suspended sentences.  

Tenants who evade rent payments are stealing from the Owners pocket, but, are consistently let-off by the Court system.

According to Minister Buswell, the amendments propose to ‘provide greater balance between the rights and obligations of tenants and lessors and enhance the clarity and effectiveness of the legislation'.

These remarks are gobbledegook.

Consider the way in which Residential Tenancy dispute matters are heard and determined in a Magistrates Court.

The Magistrates Court in WA may be constituted by a single JP acting alone, records are not required to be kept and determinations of Magistrates Courts are not freely publicly available or reported to any central authority.

Decisions made by Magistrates are not reflective of common law or legal precedent and are the personal whim of the individual JP’s or Magistrate on  the day.  There is NO appeal and NO case law on which to base any decision or appeal.


Property Owners are barred from having any legal support in a hearing - the new Bill provides that an errant tenant can have a lawyer paid for by the Lotteries Commision or other public funds.

Only fines, not favours, for the Property Owner.
